”RACCOON COMMERCE, Inc.” (hereinafter referred to as the ”Company”) realizes the proper protection of personal information (hereinafter referred to as ”Personal Information”) of users (hereinafter referred to as ”Service Users”) of ”SUPER DELIVERY”, the website operated by the Company (hereinafter referred to as the ”Website”) is an important social responsibility of the Company, thus it herein establishes and shall comply with this Policy.

1. Personal Information: Definition

The Company considers Personal Information as any information pertaining to a specific individual, by which such individual may be identifiable, including any description, symbol, image and sound.

2. Personal Information: Collection and Use

The Company shall be the sole owner of all information collected from Service Users through the Website, including but not limited to those Personal Information. Any Information collected from Service Users through the Website shall be in the sole possession of the Company. Further, the Company may record the phone calls for emergency purposes (in the event where cooperation in police investigation is requested or where confirmation is requested by Service Users), or to improve the quality of services provided by the call center representatives or to help the Company verify the service details.

The Company shall not sell, share or provide any Personal Information to any third parties without obtaining prior consent from each individual, except for the reasons stated in this Privacy Statement. Provided, however, that such Personal Information shall be disclosed if disclosure of such information is lawfully required by the government, local authorities or a court of law, or if such information is required for the shipment of merchandise or the payment settlement by outsourced agents, or if such consent is not required based on certain laws and regulations.

The Company may use the Personal Information collected from Service Users for the following purposes:

  • - To provide information regarding the Company or information relating to the services provided by the Company including distribution of e-zines and information materials;
  • - To provide the Website and its related services;
  • - To solve problems which may arise from business activities that primarily take place in the Website;
  • - The Company’s finance and accounting activities; and
  • - To develop the Company’s new businesses.

The Company uses Personal Information collected from Service Users during the following processes (a-e) on the Website:

The Company shall notify the Service Users of any additional purpose(s) or the changes made on the purpose(s) of use via email or announcement on the Website in the event where the purposes of collecting Personal Information, which were initially limited to the provision of the Company’s services or information, have to be significantly changed.

  • a. Membership Registration (for Retailers and Client Companies)
    Those who wish to use the Website need to make membership registration on the Website. Such parties wishing to use the services provided by the Company should provide their contact details (name of contact person, email address and office address) to the Company on the membership registration.
  • b. Placement of Orders
    Service Users may provide information different from those previously registered with the Company as additional information (such as delivery address) for single order.
    The information previously registered with the Company shall include credit card information and delivery address.
  • c. Request for Information Materials and Seminar Sign-up
    The Company accepts request for information materials from those who wish to use the services provided by the Company as a Client Company on the Website. Such parties need to provide their company information (name, office address and phone number) and contact person information (name and email address) to the Company.
  • d. Inquiries
    The Company has made available the inquiry form within the Website as an additional communication means other than telephone, fax and email. Those who wish to use the inquiry form are required to provide their company name, phone number and email address on the form in order to receive the response.
  • e. Cookies, Access logs and Web beacons
    The Website uses Cookies for the purposes of Service User's login session management, etc.
    Cookies are small data files that are used to transmit data to the Service Users’ computer from the web server when they accessed the Website.
    Service Users may opt out of receiving Cookies by changing their web browser settings, however, by doing so, such Service Users may not be able to access some of the services provided by the Website as the Company’s web services are operated based in a Cookie-enabled environment.
    The Website may employ Cookies or a technology called Web beacons (also referred to as clear gifs) in order to measure and report the effectiveness of the advertisements placed by Internet advertising agencies under contract with the Company.
    The Company uses an online advertising service provided by Google, Inc. The Company conducts its online advertisement using the remarketing function and similar audience features. By using these features, the Company’s ads are posted on various websites on the Internet, via third party distributors including Google, Inc. In addition, third party distributors including Google are distributing ads based on the access logs to websites with the use of Cookies. You have the option of opting out these Cookies on your own.

    The Company collects information from access logs for the purpose of researching the usage of the Website. Although the access logs contain Service Users' ID, such IDs shall not be included when the aggregated usage data is disclosed to third parties.

3. Disclosure of Personal Information to Third Parties

The Company shall clarify the purpose of use of Personal Information, and it shall only handle them within the scope necessary to attain such purpose of use.
The Company shall notify Service Users of any additional purpose(s) or the changes made on the purpose(s) of use via email or announcement on the Website in the event where the purposes of collecting Personal Information, which were initially limited to the provision of the Company’s services or information, have to be significantly changed.
The Company uses third party carrier services for the shipment of merchandise. Additionally, the Company uses credit card billing companies, if Service Users wish to use their credit cards for the payment of the fees and charges relating to the merchandise and the use of the services provided by the Company.

The Company may entrust part of its operations on the Website to third parties as the above cases. Also, the Company may enter into a service contract with third party service providers for special services. In such cases, the Company may share all information required by such entrusting third party service providers (Service Users’ name, other contact information and billing information including credit card number).
The Company shall manage and supervise each entrusting third party service provider by respectively entering into a non-disclosure agreement with them in order to ensure that Personal Information entrusted to them shall not be used for the purposes beyond the scope of their entrusted business.

4. Sharing of Personal Information

The Company may share the collected Personal Information with its group companies as follows (a - e):

  • a. Items of Personal Information to be shared with the group companies:
    Although any items of Personal Information may be shared with the Company’s group companies, such group companies shall only use such Personal Information to the minimum extent only necessary for performing its business activities.
  • b. Group companies to share such Personal Information with:

  • c. The purpose of sharing the Personal Information:
    The purpose of sharing the Personal Information with the group companies is the same as the purpose of use as provided in “2. Personal Information: Collection and Use.”
  • d. Administrator of Personal Information to be shared with the group companies:
    The administrator of Personal Information shall be the Company.
  • e. Collection of Personal Information
    Personal Information to be shared with the group companies shall be the information that the Company collected through the Internet, postcards and fax.

5. Links to Other Websites

The Website contains links to other websites. Although the Website contains links to other websites, it does not mean sharing of the Personal Information with those websites. The Company assumes no responsibility whatsoever for any collection or use of Personal Information which takes place at the linked external websites. Therefore, it is individual Service User’s responsibility to read and understand the privacy statement provided by each of such linked external website.

6. e-zines

The Company provides a web form for Service Users to select between opt in and opt out of receiving the e-zines sent by the Company to the email address provided at the time of membership registration.

7. Questionnaires

The Company may, from time to time, request information from Service Users using a questionnaire. Participation in a questionnaire survey is optional, thus each Service User may decide whether or not to disclose such information. Information required may include Personal Information (name, address, postal code and age, etc.). Contact information, among the information, may be used for the notification of questionnaire results. The information collected through questionnaires shall be used only for the purposes of monitoring and improving levels of satisfaction on the Website.

8. Management of Security and Personal Information

The Company shall take all possible preventive measures to protect any information of Service Users.
SSL, the industry-standard encryption method is used for data transmission when the Service Users submit important information through the Website.
The Company ensures that privacy is protected throughout its business operation by regularly providing information security and privacy protection training to all of its staff members.

9. Correction and Update of Personal Information

The Company provides a web form on the Website for Service Users to personally request for the disclosure or change of their own Personal Information as well as to discontinue the use of the services provided by the Company. Also, Service Users may personally contact the customer support desk (please refer to “10. Help Desk Handling Customer Complaints and Inquiries” for more details) to make a request.
The Company shall handle such request without delay according to the procedure separately specified by the Company.

10. Request for your Own Personal Information

The Company shall properly and promptly respond to any request submitted by Service Users for disclosure of their own Personal Information after identification of the Service User requesting such disclosure is verified.
If a Service User finds any errors in the Personal Information maintained by the Company after the disclosure of such information and informs the Company of such errors, the Company shall, in principle, accept a request for correction or deletion of such errors.
The Company shall comply with a request for the suspension of use of Personal Information when such information is (1) used for the purposes other than those provided in the Privacy Statement; (2) illegally collected; or (3) provided to third parties without such Service User’s consent.
