Why was it abolished even though it handled many disputes? In addition to these institutional questions, this paper will also clarify the ideological aspect of the role of kan'yo in the founding of the Japanese court system and its evaluation, as well as its influence on the period before and after the introduction of kan'yo. This book examines the specific functions* and historical roles played by the mediation system, focusing on the mediation system during the period of restoration and turmoil, the land and house lease mediation system in the 1920s, and the financial obligation mediation system in the 1930s, while also touching on small farm mediation and special wartime civil conciliation in the 1940s. Specifically, the paper analyzes the quantitative aspects of the use of the mediation system using judicial statistics, and empirically shows how each mediation system was introduced and the actual status of dispute resolution. In particular, the paper critically examines the conventional view of the mediation system, which emphasizes Japanese cultural values such as harmony and reciprocity, and presents a new perspective on the Japanese mediation system. |
